I have now received comments from other FCO Departments (FED, NTD, PCD and Legal Advisers) on the draft Understanding contained in Peking telno 44 of 4 May which Hong Kong and Peking agree should form the basis of the draft we present to the Chinese. There are too many comments to list them individually, (they are at folios (40) to (55) on file HKK 349/1), but
the most substantial are from Mr Glover in NTD and Mr Whomersley, NTD's Legal Adviser, both of whom were closely involved in the negotiations on the UK/China Consular Agreement, held in Peking in April 1983. Their particular concern is to ensure that the status accorded to the Chinese Visa Office is not more generous than that which the Chinese have shown themselves willing to grant to our Consulate General in Shanghai.
2. I have coordinated all the comments received, and now attach / two draft telegrams to Peking. The first contains comments
on the individual provisions of the draft in Peking telno 44; the second contains an amended version of the draft. The telegrams have been cleared with other interested departments (listed above)
3. Once we receive Peking's and Hong Kong's reactions to our comments, we shall have to decide whether we need to submit the papers for Ministerial approval before authorising Peking to go ahead and present the draft to the Chinese.
