Considering that the regime currently in force concerning the entry, residence and exit of foreigners, contained in decree-law No 264 B/81 of 3 September, does not deal with the special case of foreigners resident in Macau, who are not yet resident in Portugal;

Considering that Macau is a territory under Portuguese administration and that the Governor represents, in Macau, all the organs of sovereignty, except courts;

Considering the convenience of regulating, in particular, the specific situation of those who have, or will have, a valid certificate of residence simultaneously in Portugal and Macau;

to

Considering the convenience that may result for those under the administration of a regime that takes in account those circumstances;

Considering the understanding between the Central Government and the Governor of Macau in this field;

Therefore in the terms of sub paragraph a) of No 1 art 201 of the Constitution, the Government decrees as follows:

Article 1. Foreigners resident in Macau who apply for a residence permit in Portugal will be covered by the regime of arts 30 and following, of Decree-Law No 264-B/81, of 3 September, with the exceptions included in the articles that follow. /This refers to the normal immigration rules for foreigners.7

Article 2.1. For the purpose of granting, maintaining or renewing a residence permit in Portugal, by the Foreigners Service, those who already have, or have simultaneously, authorisation to live in Macau and who are covered by the conditions in art 3,

will benefit from the consideration of residence in Macau as perfectly equivalent to residence in the country, whether or not they have a simultaneous address in Portugal and Macau.

2. As for the foreigners referred in the previous section the time of residence in Macau, even if before the coming into force of the present bill, is taken into account on the whole when determining the type of residence permit in Portugal to be granted or renewed under the provisions of art 34 of Decree-law No 264-B/81, of 3 September.
