silver discs, silver ornaments and gold ornaments. All 22

of the abovementioned Petitioners were also carrying small

quantities of cash in Chinese Currency and some were carrying

small quantities of Chinese Herbs.

Your Petitioners intended to bring the said

silver coins and discs and gold ornaments to Hong Kong to

sell and use the proceeds to purchase consumer goods and

fishing equipments to be taken to their respective communes

in Hoi Fung for use by their fellow clansmen of the same

district.

A cargo manifest of the said silver coins,

discs and gold ornaments was not carried on board the said

fishing vessel. Your Petitioners had no knowledge that such

a manifest is required beforehand.

On the 9th day of March, 1981, the said fishing

vessel was intercepted by the Royal Hong Kong Police launch

off Saikung within the waters of Hong Kong.

Your Petitioners were unable to produce a mani-

fest in relation to the said cargoes and charged with various

offences of importing unmanifested cargoes contrary to the

Section 18 (1) (a) of the Import and Export Ordinance, Chapter

60 of the Laws of Hong Kong. The said cargoes were also seized

by officers of the Trade, Industry and Customs Department.

Your Petitioners were convicted consequently on the 1st day

April, 1981 and were sentenced to 3 months imprisonment.

Pursuant to Section 27 (3) of the Import and

Export Ordinance, the Director of Trade, Industry and Customs

on the 26th day of March, 1981 gave notice to Your Petitioners
