PRINCIPAL FACTORS

13. The petitioner, with intent, deliberately strangled the deceased, who was his relative. He concealed her body with care,

with a view to awaiting the return of her brother intending also to kill him. He attacked him with an axe after his return when

the body was discovered.

According to the counsel who prosecuted this case, the petitioner showed no sign of remorse throughout the trial.

MITIGATING FACTORS

The petitioner is a man of previously good character who had been in regular employment. It is possible that his version is true, and that whilst he had all along nursed ill feelings

against the deceased and her brother, he had kept these under control until the incident with the radio. Moreover that he might

not have killed her but for his losing all control after she

seized his testicles.

RECOMMENDATION

16. If it is decided to commute, the petitioner's death sentence I recommend that a sentence of life imprisonment be

substituted.
