Mr. LEUNG recalled that the Deceased was a very conscientuous, helpful and active person who had once been a volunteer for wong Tai Sin Community Centre and also a swimming instructor for youth groups at Y.M.C.A. Centre. All along he was described to be hard-working, smart and friendly. However, he rarely discussed his work problems with his family. His conflict with prisoner was therefore unknown to the family before. As the Deceased was a peaceful character with no record of violent behaviour, together with his marriage plan in ..ay, 1979, his family would never imagine that he would purposefully start a fight with Prisoner. Instead, they believed that Frisoner had pre-meditated plan to take away Deceased's life in this tragedy.
F. Interview with The Prisoner
He
The Prisoner was interviewed at Stanley Prison on 25.3.80. was impressed to be a frustrated youth with strong sense of shame and remorse. Throughout the enquiry, he was cooperative, verbal and frank. Readily he disclosed his conflicts with his Office Manager, Mr. wright. He obviously was very disappointed and shameful at his dismissal by Mr. wright but he denied to have any jealousy or hatred towards the Deceased. Further he explained that he had been so cross when the Deceased used abusive language during their quarrel. During the ensuing fight, he had unintentionally killed the Deceased. Repeatedly he declared that he had no pre-meditated plan in this case and should not be punished as a murderer. At the end, he still held a defensive attitude and requested to review this case in future.
Summary
Prisoner was born in a poor family with harmonious relationship and strong family ties. All these years, he was a well-behaved and ambitious youth with strong sense of responsibility towards-family. However, due to his limited ability and blunt personality, he had not received any appreciation from the Company Hanager for his work performance. Lven worse he was forced to resign from his Company for his negligence at work. Yet Prisoner could not properly accept this failure and had subconsciously built in some hatred and jealousy against the Deceased who had fortunately got accelerated promotion after replacing Prisoner in the same Company. Then after his return to the Company, he had conflicts with the Deceased and eventually led to the present tragedy. leantime, Prisoner is very frustrated and shameful but he still holds a defensive attitude and requests to review this case again in future. Concerning commutation of his sentence, he simply states that life imprisonment is even bitter than death penalty for him.
Respectfully submitted.
