SHEWETH as follows

On the 19th day of March 1980, Your Humble
Petitioner along with Cheung Wai Bun and Ly Minh was
convicted in the High Court of Hong Kong upon the
verdict of a jury of murdering Chaleb Teyfour on the
27th day of June 1979 at his room in the Hong Kong
Hotel, Kowloon, and for that offence, sentenced to
death in accordance with the Laws of Hong Kong.

On the 15th day of July 1980 Your Petitioner's
appeal was dismissed by the Court of Appeal in Hong Kong.
3.
Thereafter a Petition for Special Leave to appeal
was presented to the Judicial Committee of the Privy
Council on the 15th day of October 1981, but was dismissed.
A copy of the said Petition is attached hereto and marked
Exh. 1.

In the course of hearing of this said Petition,
Lord Russell, a member of the Board, remarked to Counsel,
Mr. Brook Bernacchi, QC, that "If this case had been
properly handled in Hong Kong, it would probably not
have been necessary even to hear this Petition".
Petitioner is informed by the said Mr. Brook Bernacchi
that he understood this remark not as having been in
criticism of your Petitioner's then legal advisers in
Your
Hong Kong, but as a criticism of Your Petitioner's conduct
at his trial.
