Amend the Merchant Shipping Ordinance.
ANNEX B
Enacted by the Governor of Hong Kong, with the advice
and consent of the Legislative Council thereof.
Short title.
Repeal of section 34D. (Cap. 281.)
1. This Ordinance may be cited as the Merchant
Shipping (Amendment) (No. 2) Ordinance 1982.

Section 34D of the principal Ordinance is repealed.
Explanatory Memorandum
The object of this Bill is to make permanent
the provisions of sections 34A, 34B and 34C of the
principal Ordinance. These sections, which provide for
the forfeiture of ships carrying excess passengers, were
enacted in 1979 as part of the sanctions against
traffickers running Vietnamese refugees into Hong Kong.
Section 34D provides that the sections are temporary
provisions unless extended by a resolution of the
Legislative Council. The sections were extended by
such resolutions in 1979, 1980 and 1981 for a further
year in each case. It is now thought desirable that
the sections should become part of the permanent law of
Hong Kong. Clause 2 of the Bill therefore repeals
section 34D.
2. There are no Public Service staffing or public
expenditure implications.
