(a)
he was ordinarily and
ordinarily resident in the U.K.;
(b)
he was free of restriction on the period for which he could remain in the U.K.
Under the proposed rules a returning resident who has been away for less than two years will only have to meet the condition at (b) above. This is a relaxation of the present rules.
Re-admission to the U.K. of persons who were
at some time settled in the U.K.

Persons who do not have the right of abode in the U.K. but who, by virtue of having been settled in the U.K. at some period during their lives, have obtained British (U.K.) passports and are currently holding such passports endorsed to show that they are entitled to readmission to the U.K. will have that entitlement preserved. It is estimated that this entitlement is held by about 100 Hong Kong residents.
