INTERNATIONAL ATOMIC ENERGY AGENCY (IAEA): ASSISTANCE TO HONG KONG

1.

PROVISION OF TECHNICAL

In 1979 the IAEA Board of Governors approved revised principles and operating rules to govern the provision of technical assistance. As a result of this a Revised Supplementary Agreement was drafted by the Agency, the text of which is contained in the attachment to Bruce Mackenzies letter of 17 Marcy (copy enclosed).

Hong Kong is a recipient of funds under the technical assistance programme and, as it is a British territory, the UK has been asked to sign the Agreement.

Correspondence has taken place between myself, Mr Watts (Legal Advisers) and Miss Parkin (Department of Energy), copies of which I am enclosing. Certain difficulties have been noted by Mr Watts in the UK signing the Agreement as it is presently drafted. I would be grateful for your comments.

Two particularly pertinent questions appear to be

whether and how the draft Agreement should be amended to make clear that it is being concluded by the UK only in respect of Hong Kong; and

ensuring that the Hong Kong Government have been adequately consulted.

I am copying this minute and its enclosures to Mr Morris (HKGD) and, at the suggestion of Miss Parkin, Mr Edwards (Legal Advisers) and would welcome any comments that they may have.
