(3) That the terms of service annexed hereto shall form part of this agreement.
(c) That the employment relationship, involving both the duty to serve and the right to receive wages, shall commenco when the seaman signs this agreement, unless some other time for the commencement of the employment relationship has been mutually agreed.
(D) That the seaman shall join the ship or be available for duty at the date and time specified by the employer, and if required to join at a port other than Hong Kong, shall travel by air or as otherwise directed. On any subsequent occasion within the period of this employment when he is away from the ship on authorised leave, he shall rejoin the ship by the time specified by the Master, other-wise the Master shall have the option of shipping a substitute.
(E) In addition to the rights given to the seaman by sections 22 and 23, if a seaman considers himself aggrieved he shall make his complaint in a quiet and orderly manner in accordance with the procedure as annexed hereto.
(F) (i) That all stores and provisions issued to the seaman are only for use and consumption on board ship, and any unused or unconsumed stores or provisions remain the property of the employer. A seaman shall not take ashore, destroy or give away any such stores and provisions.
(ii) To return in good condition (fair wear and tear excepted) before the termination of his agreement all articles provided for his personal use during the voyage by the employer.
(G) (i) To keep his quarters clean and tidy and in readiness for inspection by the Master or Officer deputed by him.
(ii) At the time when a seaman finally leaves the ship at the termination of his employment under this agreement, to leave his quarters in a clean and oderly condition to the satisfaction of the Master (or his authoried eputy). When he is ready to leave the ship the Master (or his authorised deputy) shall, on request made by the seaman issue to the scamen a certificate that the quarters are clean.
(H) That the seaman shall not secrete or he partly or privy to secroting a stowaway or goods of any description not forming part of his own declared personal effects on board the ship, that if any member of the crew is convicted of any act of smuggling or found in possession of dangerous drugs, and thereby any loss is occasioned to the Master or the employer, the seaman concerned subject to the provisions of section 40 and 41 of the Act may be dealt with in accordance with the regulations made under ssection 9 of the Merchant Shipping Act 1970.
(I) In all cases of salvage awards, the rating of the Chief Officer shall be deemed to be the same as that of the Chief Engineer, the rating of the second Officer that of the Second Engineer and the Third Officer that of the Third Engineer. A cadet who has not completed 2 years service shall be deemed of the rating of an Ordinary Seaman and a cadet of 2 years service or over the rating of an Able seaman.
