III The need to revise the US/UK Extradition Treaty Briefing on this subject is contained in the telegram to Washington issuing on 2 October and in paragraph 3

of Sir Ian Sinclair's minute of 1 October. Copy of Treaty and Strasbourg Convention are attached.

12. It would be interesting to know whether any amendment to the Treaty would in fact be necessary to enable the recently introduced Bill (which reserves to the US Secretary of State responsibility for deciding whether an offence was political) to have effect in respect of UK extradition requests to the USA, since so far as we and the Home Office can see the Bill is not inconsistent

with the Treaty, Article 5 of which reads

(i)

Extradition shall not be granted if :

(c)(i) the offence for which extradition

ed is requested is regarded by the requesting Party as one of a political character
