Protection of Trading Interests Act 1980

Thank you for your letter of 18 May and for a copy of letter of 29 April from the Department of Trade.

It appears that there are differences of opinion over the interpretation of section 8(6) of the 1980 Act. We have been informed by the FO vide its Savingram No. 4 of 9 June 1980 that

the 1964 Act was extended (apart from the Channel Islands and the Isle of Man) only to Hong Kong. The 1964 Act remains in force in these territories until repealed by virtue of extension of the 1980 Act by Order in Council."

Our solicitors have also advised that section 8(6) of the 1980 Act has the effect of saving and retaining the Order in Council which extended the 1964 Act to Hong Kong. Section 4(3) of the 1964 Act provided that Her Majesty may by Order in Council direct that the Act should, as appropriate, extend to Hong Kong. The appropriate Order in Council was issued.
