PROTECTION OF TRADING INTERESTS ACT 1980

Thank you for your letter of 30 March enclosing a letter from the Government Secretariat in Hong Kong stating that the Hong Kong Government does not wish the Protection of Trading Interests Act 1980 to be extended to Hong Kong at the present time.

With reference to para. 2 of the Government Secretariat's letter, I have checked with our Solicitors who informed me that since the Shipping Contracts and Commercial Documents Act 1964 was repealed by Section 8 (5) of the Protection of Trading Interests Act 1980, the Order in Council extending the 1964 Act to Hong Kong no longer has any force. Provision was however made in Section 8 (6) of the 1980 Act for directions given under the 1964 Act to continue to operate.

It may be that the provision mentioned above confused the Government Secretariat but in the view of our Solicitors, the 1964 Act is not now extended to Hong Kong, and you may wish to point this out to them and invite them to reconsider their decision.

I should be grateful to be kept informed of progress in this matter.
On a related topic, I should be grateful if you would let me know how far the Bermudian Protection of Trading Interests Act has progressed in their Parliamant.
