These facts were duly reported to the Crown Prosecutor whose view interalia was, that although the destructior of private property belonging to Illegal Immigrants may found criminal liability it was more appropriate in this case for the matter to be dealt with disciplinarily.

Having given careful thought to all the circumstances and takin; into consideration the very unusual nature of the task undertaken by the S3U, expecially at the time in question, I have di coted that no action should be taken against those junior police officers who were at fault. Those who were responsible for the daily supervision of the SBU will however be dealt with by means of internal action.

A report describing the CAPO investigation and its outcome

will be tabled at the UPG/CAPO meeting on 16 April.

I hope that the above facts will enable you to formulate

a reply for the FCO, but if I can be of any further assistance, please do let me know. In this respect, I would finally add that none of the alleations contained in the attachment to Mr Canavan's letter to Lord Carrin ton have been substantiated. You will recall that this was forwarded to you by Patrick Williamson unter cover of his

K 382/3 of 5 October 1980.
