I have considered the documentary evidence listed above in an endeavour
to establish which of two circumstances of discharge (2) or (3) is the more likely.
The evidence from the photographs shows that the outer flat door was locked,
bolted and the security chain was in the 'secure' position when the photograph
C/1A was taken. The photograph C/1D shows the bedroom door shut whilst the
photograph C/1E shows the bedroom door lock on the floor with the mortice in the
locked position. The implication of these two photographs is that the bedroom
door was locked by the deceased and this is re-inforced by the photographs
C/10 and C/1P which show what are stated to be the deceased's keys on a table.
Other photographs show that the living room and bedroom windows were closed and the
security catches were on. These windows are on the outside of the building which
is seen from photograph C/2C to be multi-storied and on high ground.
Neither of
The kitchen windows do not appear to be on the outside walls.
the windows has security bolts and both appear to be held closed by a spring
loaded catch; they are both barred. The bathroom windows appear to open on to a
recess in the outer wall. These windows show no security bolts and are held
closed by spring loaded catches.
Neither window is barred.
The lack of security bolts on the kitchen and bathroom windows makes these
windows easier to force open and the fact that the kitchen windows open on to a
corridor within the building male these windows vulnerable to forced entry
in spite of the bars.
The photographs of the deceased in the flat, C/1H, C/1J, C/1K, C/1L and
C/3A and in the mortuary C/4A, C/4B, C/4C, C/4D and C/4E show 5 entry wounds in
the front of the body and 3 exit wounds in the back.
In my experience the choice of the frontal chest area is very rare in
self inflicted gun shot wounds although its use is not unknown to me. It is
quite feasible, in my view, for a person who has elected the frontal chest area
to use a revolver of the type shown in the photographs, to self inflict gunshot
