10.

Officers and employees of the Visa Office

shall not be amenable to the jurisdiction of the judicial

or administrative authorities of Hong Kong in respect

of acts performed in the exercise of Visa Office

functions:

Provided that this section shall not apply in

respect of a civil action either

(a) arising out of a contract concluded by an

officer or employee in which he did not

contract expressly or impliedly as an

agent of the People's Republic of China; or

Waiver of privileges

and

immunities.

(b) for damages arising from an accident in

Hong Kong caused by a vehicle, vessel

or aircraft.

The Director

(1) Head of the Visa Office may waive, with

regard to any officer or employee of the Visa Office, ·

any of the privileges and immunities provided in

sections 9 and 10.

(2) Except as provided in subsection (3) the

waiver shall be express and shall be communicated in

writing.
