Following my call on you on 5 August, I have now been instructed by the British Government to seek to formalise

an understanding between our two sides for a trial period of three months in which the new arrangements for Chinese passport holders in transit through Hong Kong may be tested.

These new arrangements, which were put forward by Mr Owen when he called on Mr Liu on 28 May 1981, are as follows :

The British side are prepared, for a trial period, to relax

the existing rules so that holders of Chinese passports (whether coming from China or elsewhere) with valid documents and means for continuing elsewhere will normally be given seven days transit in Hong Kong and will be able to extend up to one month providing they have legitimate grounds. concession can be made only on the following conditions :

(a) Those arriving from China without visas for Hong

Kong will be processed, as now, at Lowu. This is for practical reasons. Processing elsewhere would delay other passengers:

Those from elsewhere would have to be going directly to China and have, if necessary, entry

visas:

Chinese passport holders who remained in Hong

Kong beyond one month will be accepted back automatically by China except, in the case of Chinese passport holders who have right of residence elsewhere, who should be returned to

their country of residence and not to China.
