and it is immaterial whether the identity
card or other document is in such custody,
possession or place for the use of the
accused person or that of another person.".

Explanatory Memorandum
This Bill has two objects.
By clause 3 it provides a sanction for non-
compliance with section 5 of the principal Ordinance
(duty to use registered name and to submit number of
identity card).

By clause 4 the Bill makes it an offence,
punishable on indictment with a maximum of 7 years
imprisonment and a fine of $50,000, and on summary conviction with a maximum of 2 years imprisonment and
a fine of $20,000, to possess forgeries of identity
cards or other documents issued under the principal
Ordinance.
By new section 7A(2) "possession" will be
given a meaning which is adapted from section 80 of the
Crimes Ordinance.
