Kowloon-Canton Railway (Restricted Areas) Regulations 1981

The object of the regulations is to enable the General Manager Railway, following the introduction of the through train service to China, to declare certain areas of the railway to be restricted areas and to provide for a permit system of entry into such areas. The powers and provisions proposed are generally in line with those in existence under the Hong Kong Airport (Restricted Area) Regulations.

Regulation 3 seeks to empower the General Manager to declare in the Gazette any area within the railway to be a restricted area, either absolutely or at a specified time.

Part II of the regulations provides for the issue and cancellation of permits. Regulation 5 provides that no person shall enter or remain in a restricted area unless in possession of a valid permit issued to him. Detailed provision for the grounds for refusal to issue permits, the contents of permits and the duration of validity, the surrendering of permits on cessation of employment or upon demand, and loss and replacement of permits are also included.

Regulation 6 provides that the General Manager may issue either pool permits (which will be in favour of specified public officers) or standard permits (which will be issued to individuals). Regulation 14 requires the permit holder to wear the permit in a conspicuous place on his outer clothing when entering or remaining in or departing from a restricted area.

Regulation 15 exempts (subject to certain conditions) from the provisions of regulation 5 any bona fide train crew members and train passengers who are travelling to or from China on the through train service and who are in the course of passage through a restricted area.

Part III deals with offences and other miscellaneous matters, including powers of the General Manager to exempt any persons, subject to such conditions as he may impose, from any requirement regarding' entry into a restricted area,

Under regulation 19 an authorised person may arrest any person who is in the restricted area in contravention of regulation 5 and immediately take him to a Police Station.
