Normally, in the case of private treaty grants of vacant Crown land sites, there is a restriction on alienation until a certificate of compliance is issued. In certain circumstances, however, which have included development grants to the Corporation, alienation at an earlier stage may be allowed with consent and subject to conditions, depending on the circumstances of the particular grant. In these particular cases, the Mass Transit Railway Corporation has incurred substantial expenditure, for its own purposes, within the sites and, in some cases, has already partially constructed foundations for future development. It is considered that in the special circumstances of these grants, the Corporation should be allowed to assign each lot once as a whole (i.e. the non-Mass Transit Railway part) subject only to obtaining an undertaking from the purchaser in favour of Government that the building covenants will be fulfilled, and that no assignments will be entered into, until the undertaking has been complied with. In this way, the Corporation need not itself be involved in the development of these lots, but the purchaser from the Corporation would not be allowed to sell (without consent in the normal way under the Land Officer's Consent Scheme) until the certificate of compliance has been issued.

The Corporation has now applied formally for the grant of the seven sites set out in paragraph 1(a) above for development. Details of these sites including the proposed basic terms of the grant are set out in Annex B. The areas and lease terms of the sites are as far as possible the same as in the former Crown leases and carving out assignments of the former lots and sections.

In addition, it has been proposed that the two further sites. mentioned in paragraph 1(b); acquired in connection with the extension to Tsuen Wan, also be granted. No formal application has yet been made but this is likely to be forthcoming in the near future and accordingly approval is sought, in principle, for the granting of these two sites to the Corporation.
