Purpose

To review the provisions of the Landlord and

Tenant

(Consolidation)

Ordinance.

Progress Made & Present Position

The Committee's Report has been generally endorsed by ExCo. As a first step towards the implementation of the Report's recommendations, the Landlord and Tenant (Consolidation) (Amendment) Ordinance 1981 was enacted, which provides the following major provisions :-

9.

(a) the extension of Pt. II of the

Ordinance for two further years beyond the present expiry date of 18th December 1981;

(b) the raising of the biennial

percentage ceiling on rent

increases from 21% to 30%; and

(c) the exclusion from Pt. II of

(i) tenancies of premises in

respect of which an

occupation permit is

first issued on or after

19th June 1981; and

(ii) after 18th December 1981,

tenancies of premises

having a current rateable value cf $80,000 or more;

and

(iii) after 13th December 1982,

tenancies of premises

having a current rateable value $50,000 or more.

Next Quarter Target

To continue examining the Report's recommen- dations with priority given to the proposal regarding the expanded role of the Lands Tribunal to provide mediation between landlords and tenants-- of premises excluded from Pt. II of the Ordinance.
