6. We do not know how the misunderstanding over UK practice arose. There were some consultations here in the Spring and Summer with our Legal Adviser. However, policy considerations were not examined, nor was the idea of an amendment to Letters Patent then pursued. Philip Morrice mentioned this in his letter to you of 28 November. Fortunately, as things have turned out, we do not find ourselves in the embarrassing position of having to disagree with the Hong Kong Government after the advice of EXCO had been sought.
