1. Whether it is necessary for the Governor to consult Ministers

further on the precise timing of legislation to allow for the return

of all illegal immigrants from China..

Recommendation

2. I recommend that Sir E Youde be authorised to speak to the

Governor along the lines of the attached note when he sees the

Governor in Hong Kong shortly.

Background and Argument

3. The Governor has recommended, and Ministers agreed, that as

from about the end of October all illegal immigrants from China

should be repatriated even if they have reached the Urban Area

(APS/Mr Blaker's minute of 29 July). As part of the scheme, known

Champion', it will be necessary to introduce legislation in

Hong Kong making it an offence not to carry an identity card at all

times in public and to employ anyone who does not possess such a

card.

4. Since then, it has been agreed that, after the Secretary of

State discusses the problem of immigration with Huang Hua, the

Governor should visit the Governor of Guangdong to explain what

he proposes. When Mr Blaker agreed this visit, he said that the

Governor should consult London at the appropriate time about the

exact date for legislation in Hong Kong and for introducing the

scheme in the light of the fact that Parliament resumes on

27 October (Mr Blaker's note on Mr Morrice's submission of

11 September).
