On 27 August and 12 November 1974 the Director of the Shum Ch'un Foreign Affairs Bureau and the representative of the Kwangtung Foreign Affairs Bureau and the Political Adviser and Secretary New Territories of the British authorities in Hong Kong held talks at Shum Ch'un and have come to an oral agreement on the following items:-

(1)The British authorities in Hong Kong in principle will not give permission to enter or stay in Hong Kong to Chinese inhabitants who go there illegally without ratification and valid certificates issued by the Chinese departments concerned, and will send them back quickly. As to the persons who have engaged in organising illegal crossing of the local border and those who have hijacked the means of transport or have taken other illegal methods to enter into Hong Kong, the British authorities will take effective measures to send them back.

(2) The above-mentioned personnel will be taken over by the local civil affairs department when they are sent back from Hong Kong, but the Hong Kong side should provide a name list in advance through the China Travel Service (Hong Kong) Limited at Lowa and hand them over at Man Kam To at a mutually agree- able time. Special arrangements can be made through mutual consultation for some specific cases.

(3) If among the above-mentioned personnel from Hong Kong some persons do not belong to those described in Item (1), the Shum Ch'un side will notify the Hong Kong side at any time and repatriate them.

(4) The means of transport taken or hijacked by the

above-mentioned personnel who go to Hong Kong illegally will be returned by the concerned department of the Hong Kong British authorities to the Chu Kong (i.e. Pearl River) Shipping Company Limited. If the means of transport belong to Po On District, the commune or production brigade in this locality can send their representatives to the nearby Hong Kong police station to collect them. The Hong Kong side will be informed of the names of the representatives by the China Travel Service (Hong Kong) Limited.

The above agreement will be put into effect from 30 November, 1974.

(6) If any problem arises in the implementation of the

above items, discussions by both sides will be held to solve them.
