(ii) there is a substantial risk that upon

birth the child would have such physical or

mental abnormalities as to be seriously

handicapped (section 47A(1)(b));

(b) it shall not be unlawful for a registered

medical practitioner to terminate the

pregnancy

(i) of a woman under 17 years of age; or

(ii) of a woman who within 3 months of the

date thereof has made a report to the police

that she has been the victim of any one of

the following offences

(1) incest;

rape;

(3)

intercourse procured by threats;

(4) intercourse procured by false

pretences; or

(5) intercourse procured by drugs;

(section 47A (2A))

it shall be unlawful to terminate a pregnancy

of more than 24 weeks duration unless termina-

tion is necessary to save the life of the

pregnant woman (section 47A (2B)).

Clause 5 inserts 3 new sections

(a) it introduces the offence of child destruction

(based on the UK Infant (Life Preservation)

Act 1929) to protect an unborn child capable

of being born as a living child but before

the child has an existence independent of its

mother (new section 47B);
