The Criminal Procedure Ordinance is amended -

Consequential amendment of

Criminal Procedure Ordinance.

(Cap. 221.)

(a) by deleting the sub-heading before section.

77 and substituting the following

"Pregnancy"; and

(b) by repealing section 78.

Explanatory Memorandum

This Bill seeks to consolidate and revi se

the law relating to abortion, child destruction and

infanticide.

2. Clause 3 amends section 46 of the principal

Ordinance to provide differing maximum terms of

imprisonment for a woman procuring her own abortion

(7 years) and the, illegal abortionist (life). In

addition the Court is empowered to punish both classes

of offender with such fine as it may award.

3. Clause 4 amends section 47A of the principal

Ordinance to provide that -

t

(a) it shall not be unlawful for a registered

medical practitioner to terminate a pregnancy,

if 2 registered medical practitioners are

of the opinion, formed in good faith that -

(i) the continuance of the pregnancy involves

risk to the life, or injury to the health of

the pregnant woman greater than if the

pregnancy were terminated (section 47A(1)(a));
