the plan submitted to the satisfaction of
the Director under regulation 7(1)(b) of the
principal regulations in relation to such
licence shall be deemed to be a plan
approved by him under regulation 9 of the
principal regulations as amended by these
regulations.

Explanatory Note
The main effect of these amendments to the
Offensive Trades (New Territories) Regulations is to
(a)
remove references in the regulations to the
establishment of offensive trades areas in
the New Territories, no such areas having
been declared;
↓
(b) provide a single procedure for the granting
of licences to carry on an offensive trade
wherever the premises are situated in the
New Territories; and
(c) increase the penalty for carrying on an offensive
trade without a licence, in line with current
penalties for similar offences in other public
health legislation.
