Health and Urban Services (Amendment) Bill 1980.

The purpose of the Bill is to amend the Public Health and Urban Services Ordinance so as to strengthen existing controls over bill- posting on Crown and private land.
Background

The existing legislation relating to bill posting is contained in the following Ordinances and By-laws:-

Section 4(18) of the Summary Offences Ordinance (Chapter 228), which prohibits the posting of handbills, notices or proclamations in Chinese without the permission of the Secretary for Home Affairs or the Secretary for the New Territories. This provision, which in practice appears to be aimed at preventing the posting of notices which are detrimental to the peace and good order of the community rather than controlling the indiscriminate posting of bills and notices, is being considered for repeal. Section 8(b) of the Summary Offences Ordinance which makes it an offence for any person, without the consent of the owner or occupier, to affix any poster or other paperagainst or upon any building, wall, fence or paling. Section 6 of the Crown Land Ordinance (Chapter 28), which prohibits the unlawful occupation of Crown land. However, in the context of bill-posting, section 6 is of value only where an advertising hoarding is unlawfully erected on Crown land.
By-law 1 of the Advertisements By-laws (Chapter 132 Sub-leg.) which prohibits the affixing or exhibition of any advertising hoarding, notice board or poster on private, railway or Crown property without permission.
