A BILL

To

Amend the Factories and Industrial Undertakings Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1.

This Ordinance may be cited as the Factories and Industrial Short title. Undertakings (Amendment) (No. 2) Ordinance 1980.

The proviso to section 7(5) of the principal Ordinance is amended Amendment of by deleting "$10,000" and substituting the following-

"$50,000".

3. Section 11(3) of the principal Ordinance is amended by deleting Amendment of "$10,000" and substituting the following-

"$50,000 and to imprisonment for 6 months".

Explanatory Memorandum

This Bill amends the Factories and Industrial Undertakings Ordinance to increase the maximum penalties-

(a) that may be provided in regulations made under section 7 of the Ordinance. The fine of $10,000 is increased to $50,000 (clause 2); (b) that may be imposed under section 11 of the Ordinance for any contravention or failure to comply with any order made by a magistrate to safeguard against dangerous conditions and practices in industrial undertakings. The fine of $10,000 is increased to a fine of $50,000 and imprisonment for 6 months (clause 3).

一九八○年工廠暨工業經營(修訂)(第二號)法案

摘要說明

本法案修訂工廠工業經營條例,以提高下列各項之最高刑罰-

(甲) 依照原有條例第七條所制訂規例可規定之最高罰款原為一萬元,現增至

五萬元(法案第二條);

(乙) 根據原有條例第十一條之規定,凡違反或不遵照裁判之命令而未有採

取安全措施,以消除工業經營內之危险情况及工作上所引致之危險者, 可被判處之最高罰款為一萬元。是項處罰現改為罰款五萬元兼監禁六個 月(法案第三條)。

二、 本法案對政府經費及人手需求並無影響。
