Miss Brown passed on to me the request recorded in Mr Murray's minute to you of 25 March that we should look further into the "grey area of the relationship between the appeal procedure and a direction by the Secretary of State for Trade under Section 4 of the Civil Aviation Act.

I attach a copy of Mr Gardiner's minute of 25 March giving the legal advice on this point. I fear you will not find it very encouraging. However, paragraph 8 of the minute suggests a number of pertinent questions which Mr Cortazzi might like us to consider collectively at his meeting at 9.30 tomorrow. occurs to me that there might be a case for urging the Governor to let us have his comments even sooner than the time-sacle we agreed between us (ie early next week if he had not already telegraphed by then) since there seems to be a good case for an FCO inter- vention if we decide that this would be appropriate taking place before the appeal procedure gets under way.
3. Following our telphone conversation this afternoon, I have asked Mr Gardiner to attend Mr Cortazzi's meeting and he has agreed to do so.
