Background

Section 6 of the Dangerous Goods Ordinance (Chapter 295) provides that no person shall manufacture, store, convey or use Dangerous Goods except in accordance with a licence granted under that Ordinance.

Arising from this requirement, the Dangerous Goods (General) Regulations make specific provision, inter alia, for licensing the storage of compressed gases (i.e. Category 2 Dangerous Goods).

However, the Regulations in question relate only to the licensing of the stores themselves, and not to any pipelines installed for the purposes of distributing gas from the stores to the premises in which they are situated. Thus a situation could arise where a store met all safety requirements and was licensed, but the distribution pipelines leading from it were defective and perhaps dangerous. This could occur, for example, in the case of LPG stores serving domestic accommodation, or stores containing compressed gases used in industry. In Information Note XCRI(80)22 dated 10th July 1980: "Control of Containers of Compressed Non-Inert Gases", it was noted that proposed amendments to the Dangerous Goods Regulations, in relation to distribution pipework leading from DG Stores, would shortly be introduced for Members' consideration.

Proposal

It is proposed, in regulations 2 and 3 of the

Dangerous Goods (General) (Amendment) (No 2) Regulations 1980 (annexed), that the existing licensing provisions in regulations 62 and 77 of the principal regulations for Category 2 Dangerous Goods stores should be extended to include any pipelines provided to distribute gas from the store to any part of the premises in which the store is situated.
