Draft Second Optional Protocol to the
International Covenant on Civil and Political Rights
The States Parties to the present Protocol
have agreed as follows:
Article 1
1. Each State party shall abolish the death penalty in its
territory and shall not threaten to use it against any
individual subject to its jurisdiction or impose or
execute it.
2.
The death penalty shall not be re-established in States
that have abolished it.
Article 2
1.
As between the States Parties Art. 1 of the present Protocol
shall be regarded as an additional article to the Inter-
national Covenant on Civil and Political Rights of 19th
December 1966. The provisions of the Covenant shall apply
accordingly.
2. Nevertheless, the competence of the Human Rights Committee
established under Article 28 of the Covenant to receive
and consider communications, resulting from a declaration
