CLAUSE 3 provides penalties for failure to comply with requirements imposed under Clauses 1 and 2. It provides for a maximum fine
of £1,000 on summary conviction and for an unlimited fine on
conviction on indictment.
CLAUSE 4 provides that in proceedings under the Evidence (Proceedings in Other Jurisdictions) Act 1975 United Kingdom courts shall not
comply with a request made by a court of an overseas country when the Secretary of State has given a certificate that the request infringes United Kingdom jurisdiction or is otherwise prejudicial to United
Kingdom sovereignty.
CLAUSE 5 provides that judgements for multiple damages given in civil proceedings by courts of overseas countries shall not be enforceable in the United Kingdom. It further provides that judgements given in overseas countries based on competition laws which have been specified by an order made by the Secretary of State shall not be enforceable in the United Kingdom.
CLAUSE 6 enables United Kingdom citizens, United Kingdom corporations and other persons carrying on business in the United Kingdom to
sums paid under foreign judgements for multiple damages in excess of the compensation for the loss of the person in whose favour the judgement was given.
