with reference to our telephone conversation as well as to the letter

of the Chief Secretary of the Government Secretariat of December 10,1977

S2) (CR 51/2091/67) and the reply by this Consulate General of February 22,

1978 (RK 516) concerning visa requirements for Hongkong British passport

holders entering the Federal Republic of Germany, I regret that I am

still not in a position to give you a favourable reply.

Inspite of your Government's commitment never to refuse re-entry to a holder of a Hongkong British passport my Government is not prepared to facilitate visa-exemptions for such persons since the British Government in accordance with the Commonwealth Immigration Act of 1968, draws a line

of distinction between proper British subjects and citizens of British overseas territories and their respective rights of entry into the

United Kingdom.

Therefore, visas will continue to be required for all holders of British passports issued by a British Consulate or a British High Commissioner or Governor of British Territory or Colony wishing to enter the Federal Republic of Germany for any period of time unless the holder of such passport either was born in Great Britain, this being expressly stated in his passport, or - according to the regulations of the Government of the United Kingdom applied since January 1, 1973 - his passport states that the "holder has the right of abode in the United Kingdom" or that the "holder is entitled to re-admission to the United Kingdom".

My Government would, however, be inclined to change its policy in favour of Hongkong British passport holders if the British Government guaran- tees to admit them to the United Kingdom whenever their deportation

should become necessary.
