The amendment in regulation 5 provides that

an identity card may be issued to a person who has

landed in Hong Kong unlawfully, but only if he is

authorized to remain in accordance with the Immigration

Ordinance.

Regulation 10 revokes and replaces the

existing regulation 19 (which creates the various

offences against the principal regulations). Where

appropriate, it has been provided that a reasonable

excuse will be a defence. The offences of aiding

and abetting, giving assistance to offenders and

forgery have been deleted from the regulation as they

arc already provided for in the Crimes Ordinance and

the Criminal Procedure Ordinance. The penalties for

offences have been increased following amendments to

the principal Ordinance. The Commissioner for

Registration is given power to cancel an identity card

in certain circumstances where an offence has been

committed, and to require the person involved to

re-register.

The amendment in regulation 12 extends the

period for which a visitor may stay in Hong Kong

without having to register, from the existing period of

90 days to 180 days.
