"Beaching or scuttling

vessel.

72A. Any person who, by any unlawful

act or in any manner whatsoever without

reasonable excuse, disables, abandons,

scuttles or beaches any vessel within

the waters of Hong Kong commits an offence

and is liable

(a) on conviction on indictment to

a fine of $200,000 and to

imprisonment for 4 years; and

(b)

on summary conviction to a fine

of $200,000 and to imprisonment

for 2 years.".

Explanatory Memorandum

The principal purpose of this Bill is to add

to the shipping and Port Control Ordinance 1978 a new penal provision under which any person who, without reasonable excuse, disables, abandons, scuttles or beaches any vessel within Hong Kong waters commits an offence

for which he may be fined up to $200,000 and sent to prison for up to 4 years if he is convicted on indictment or for up to 2 years if he is convicted summarily.

Clause 2 increases the maximum penalties which may be imposed under section 72 for the offence of

endangering the safety of persons on a vessels.
