his power would not be exercised without first consulting the National Staff Side.
20.
Departments should consult the CSD at an early stage in any case in which criminal proceedings are pending and the charges are such that the withholding of superannuation benefits is a possibility. Department should subsequently notify the CSD of the outcome of the trial and the possibility of appeal and, if there is a conviction should recommend whether or not superannuation benefits should be wholly or partly forfeited. If it is agreed that the case falls to be considered within the forfeiture rules
of the PCSPS, the officer should be invited in writing to submit, within a reasonable time, any written representations he wishes
the CSD to take into account when they are consideirng whether or not he should suffer forfeiture. He should be avised that
such representations may be made on his behalf by a colleague (who may be a trade union representative). The officer should
not at that stage be given any indication of the likely extent of any forfeiture that may be imposed.
21. No action should be taken either to pay superannuation benefits to a serving officer or to withhold them from somebody who has already retired where there is any question of forfeiture of part or all of superannuation benefits until the CSD hàs indicated its decision. In all cases except treason the officer has a right - of appeal to an independent board nominated by the CSD (this will usually be the CSAB) before forfeiture is implemented, and the
recommendation of this board is binding on the CSD.
