I refer to my letter of the 30th August and write to advise
you that the Writ has now been served.
Accordingly, as promised, I now enclose draft retainers in
precisely similar terms for Dr. David Owen and Lord Goronwy-Roberts
and I should be glad if you would be kind enough to complete these by
inserting their full names, addresses etc. and then have the forms
re-typed for submission to them for their signature.
You may
perhaps, have observed that I have omitted from
the draft the usual authority to the Treasury Solicitor if he accepts
the retainer without further consultation to defend, compromise or
settle the action and generally so to conduct it as in his judgment
best serves the interests of the Crown.
Whilst I am sure the interests
of Dr. David Owen and Lord Goronwy-Roberts are identical with those of
the Crown, I do not feel it is necessary for them to give me this
authority for so long as they are in office I will obviously be coming
to you for specific instructions before taking any step in the action.
