A minimum carriageway width of 11 metres will be provided with footpaths approximately 2.75 metres wide on both sides. The road widening project is covered by Item KH11(3) in the Public Works Programme in Category A at an estimated cost of $4. 14 million. It is expected that work will start in June 1979.

Notification of the proposed undertaking as shown on the plan at Annex A, was first published in the Government Gazette and in the Chinese and English press on 18th November 1977 in accordance with section 3(3) of the Streets (Alteration) Ordinance (Chapter 130). During the 2 months statutory period allowed for objections and claims, 6 objections were received.

The objector's structure, which is on unleased Crown land and occupied under a Crown Land Permit has an unauthorised extension that encroaches onto Crown land required for the pavement. The objector has requested an amendment to the project works limit so that his store will not be affected.

The Highways Office has advised that the unauthorised extension of the structure need not be removed, as a footpath of the required width (2.75 metres) can be provided without affecting it. The project works limit has accordingly been slightly amended. In view of the above the Director of Lands, Survey and Town Planning has proposed to regularise the unauthorised extension. It is therefore recommended that the objection should not be upheld.

The objector operates a small shop selling electrical appliances which is situated partly within Lot No 577/3 section A sub-section 2 in Survey District I and partly on Crown land. shop is covered by the 1976 squatter control survey. Lot No 577/3 will have to be resumed to accommodate the project works. The objector has requested that the road widening plan should be with- drawn or, as an alternative, a shop unit or a vacant site of 200 square feet together with fair compensation should be granted to her.

As the lot is restricted to agricultural use and is not being used for such a purpose, the objector cannot claim for business loss under section 10(2)(d) of the Crown Lands Resumption Ordinance.
