Crown Lands Resumption Ordinance (Chapter 124)

RESUMPTION OF LAND FOR SHEK WU HII HKK 365/2 DEVELOPMENT PACKAGE 3 - BORROW AREA REGISTRY RO. 51 AT ORB HILL, SHEUNG SHUI, NEW TERRITORIESOCT 1978

Introduction

The Director of Public Works has recommended the early acquisition of certain private land at Orb Hill, Sheung Shui which is designated as a Borrow Area. This Borrow Area will provide filling material for site formation works in connec- tion with Shek Wu Hui and Fanling development over the next five years. A total area of 1,468,3 m2 (15, 804 square feet) of agricultural land will be affected. This project is in Category A of the Public Works Programme under Item NDE 5(3)- 'Shek Wu Hui development, package 3, site formation and roadworks'.

Proposal

The general location of the land to be resumed is shown coloured orange on the Identification Plan at Annex A. The Secretary for the New Territories is satisfied that the private land involved is the minimum necessary to implement this project. The clearance will involve Crown land and private land. Payment of compensation for crops, fruit trees, pine trees, fish ponds, fences, wells, irrigation pipes and removal of 25 graves/Kam Taps, together with ex-gratia allowance for cultivators and ex-gratia disturbance allowance for displaced pigbreeders and poultry farmers is necessary. Total compensation for resumption and clearance is estimated at $650,000 and funds are available in the approved project estimate to meet this commitment. The cost of ex-gratia domestic removal allowance and ex-gratia allowances for two aquaria is estimated at $64, 800 and will be paid from the Compensation Vote of the Housing Department under which funds are also available.

No building land is involved in this resumption. However, 12 temporary structures (all on Crown land) used for domestic purposes will have to be cleared. These structures are occupied by some 8 families who, if found eligible, will be offered public housing elsewhere. Families not eligible for public housing will
