period allowed for objection under section 4(1) of the Ordinance. of these objections were subsequently withdrawn. The two remaining objections from the Lung Cheung Court Management Committee (New Kowloon Inland Lot No 5195) (copy at Annex B) and the joint owners of New Kowloon Inland Lot 917 Remaining Portion (copy at Annex C) are dealt with in paragraphs 3 and 4 below.

Lung Cheung Court stands on New Kowloon Inland Lot No 5195 which is held by the Colonial Treasurer Incorporated under a Crown lease dated 27th June 1969 for a term of 99 years less the last 3 days thereof from 1st July 1898. The Management Committee is elected from among the residents of flats in the building who are Government servants holding underleases from the Colonial Treasurer Incorporated in respect of their individual flats. In addition to the letter of objection at Annex B, the Management Committee has also submitted a claim for compensation which includes monetary compensation for the loss of any land required for roadworks. The grounds for objection listed by the Management Committee in the letter at Annex B are dealt with in the following sub- paragraphs:

necessary to acquire a strip of hill-slope along the western boundary of the lot fronting Waterloo Road comprising 1, 923 m2 (about 18,000 square feet). This hill-slope has been planted with trees by the Urban Services Department. The Crown lease, under which New Kowloon Inland Lot No 5195 is held, provides, inter alia, that Government shall have full power to resume, re-enter upon and re-take possession of all For any part of the lot if required for the improvement of Hong Kong or for any other public purpose subject to twelve months' notice being given. Upon the exercise of such power, there shall be paid to the Colonial Treasurer Incorporated by the Government compensation in accordance with the formula contained in the Crown lease. In practice, this resumption will be effected by way of The Colonial Treasurer In- corporated surrendering the required strip of land as a separate section to the Crown Notice of resumption in respect of that portion of the Tot was duly served on The Colonial Treasurer Incorporated on 21st September 1977 in accordance with the provisions of the Crown lease. The compensation payable for the resumed land will be passed on to the Management Committee by The Colonial Treasurer Incorporated on an ex-gratia basis.
