The clearance will involve payment of compensation for crops, irrigation sumps, wells and fences, as well as ex-gratia allowance for cultivators.

No building land is involved in this resumption. However, one temporary domestic structure will have to be cleared. This structure is occupied by a family who will either be offered public housing if found eligible or space in a licenced area if ineligible. An ex-gratia domestic removal allowance of up to $1,000 may be payable to this family from the compensation vote of the Housing Department under which funds are available. In addition to the dome stic temporary structure mentioned above, seven (7) other temporary structures including agricultural stores and pump houses will have to be cleared.

The institution of resumption proceedings is recommended as a safeguard in the event that agreement with landowners for the voluntary surrender of their land cannot be reached and in order to avoid delays which may be caused by succession difficulties or absentee landowners. As the land to be resumed lies within the Sheung Shui - Shek Wu Hui- Fanling Outline Zoning Plan, owners of the agricultural land will be offered, subject to there being no change in policy, the alternative of land exchange entitlements on Letter 'B' terms with a credit value of $10 per square foot or cash compensation, which includes an ex-gratia sum to bring the total payment up to $17 per square foot if this cash offer is accepted prior to the expiry of the resumption notice. The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely, the construction of a temporary housing area in Shek Wu Hui Area 30 as part of Shek Wu Hui development, package 4, engineering works, Stage I.
