The purchase price

and the terms and conditions of

payment will be determined by the Authority with the

prior approval of the Governor. The Authority is also

empowered to determine the terms, covenants and

conditions of sale and the eligibility of persons to

purchase land.

The new section 17B makes void the sale or

disposal of the land purchased by an owner, or of any

interest therein, in breach of any term or condition of

the agreement for sale and purchase or any covenant in

the deed of assignment to which he is a party.

The new subsections in clause 5 provide that

the Buildings Ordinance does not apply to any building

constructed or which is being constructed by the Authority

and to any building of which no part has been sold or

otherwise disposed of under the new section 17A. The

Buildings Ordinance, other than section 21 thereof, will

however apply to a building any part of which is sold or

otherwise disposed of under the new section 17A after

the construction of the building has been completed.

Clause 6 amends section 23 of the principal

Ordinance so as to apply that section only to a building

which is vested in the Authority and no part of which

has been sold or otherwise disposed of under section 17A.

Clause 7 makes consequential amendments to

section 24 of the principal Ordinance in relation to the

power to take custody of and to dispose of property in

the circumstances stated.
