Committee which was formed in December 1974 to deal with
schools trading activities and textbooks has been an effective
instrument in rectifying and preventing malpractices. This
Committee should continue to be supported. In this connection
we also recommend that where any trading activity
takes place at a school, in the absence of specific evidence
to the contrary, the Education Department should assume
that such operations are conducted by the school. Further-
more, periodic checks thereon should be carried out to ensure
that the Code of Practice recommended by the Consumer Council
is followed. There is also merit, we feel, in the proposal
of the Advisory Committee on Corruption of the ICAC that
aided schools be included in the Schedule of Public Bodies
attached to the Prevention of Bribery Ordinance. We recommend
that the Government give favourable consideration to this proposal, on the assumption that the related legal problems
can be resolved.

We recommend that the status and functions of the
Code of Aid, in relation to the Education Ordinance, be
reviewed to ensure an unambiguous and uniform standard of
enforcement. In particular, we feel that the roles and
functions of the supervisor, members of the Management
Committee, the principal and the teachers should be more
clearly defined. The Education Department should also
encourage, as much as possible, members on Management Commi-
ttees of schools to take a closer interest in the running of
their schools.
