49. EUROPEAN ECONOMIC COMMUNITY

There are special regulations governing nationals of a country within the European Economic Community which consists of Belgium, Denmark, France, Germany, Italy, Luxembourg, the Netherlands, the United Kingdom and Ireland.

Such nationals are entitled to equality of treatment under the various national legislations regardless of place of residence or employment. Also contributions paid in one member state may count for certain benefits in another member state.

For purposes of the EEC social security regulations, Gibraltar is part of the United Kingdom; and in order to operate the regulations between the two territories an agreement is in force which treats the UK and Gibraltār as . separate member states.

If you intend leaving Gibraltar to take up residence in another member state please enquire for further details from the Department of Labour & Social Security.

GENERAL INFORMATION ABOUT BENEFITS

50. HOW ARE BENEFITS PAID?

Industrial Injury Benefit, Maternity Grants, Death Grants and Unemployment Benefit will be paid in cash at the Department of Labour and Social Security.

Industrial death gratuities will be paid by cheque at the Department of Labour & Social Security.

"Industrial pensions, Widow's Benefits, Widower's Pensions, Old Age Pensions, Retirement Pensions, Guardian's Allowances and Elderly Persons Pensions will be paid by means of a book of orders, one of which may be cashed each week at either the Department of Labour and Social Security or the District Post Offices. All the order books contain full instructions which it is in your interest to read. Orders should be promptly cashed.

Delay in cashing may lead to difficulty or to loss of benefit.

51. HOW CLAIMS ARE DECIDED

All claims for benefit and any other questions arising in connection with Social Insurance are decided by the Director of Labour and Social Security, if the Director's decision is adverse there is a right of appeal to a Social Insurance Appeals Board which is presided over by a legal practitioner. In certain circumstances there' is a further right of appeal to the Supreme Court.

52. PRISON

Benefits are not generally payable during periods of imprisonment, but in certain circumstances arrangements can be made for dependants to receive the benefits.

OVERLAPPING BENEFITS

There are special provisions which prevent the duplication of payments out of Social Insurance and other public funds. Any necessary adjustments will be

made by the Department of Labour and Social Security.
