Excepted from this provision is any agreement whereby the worker participates in a fund, provided that such fund meets requirements fixed by Ordinance.

Article 36 (Payment of wages)

Payment of wage shall be made in its full amount to worker directly in legal tender. In case there is special provision under Law, order or collective agreement, the wage may partially be deducted or payment may be made by other means than legal tender.

The wage shall be paid once or more per month at a given date. The extraordinary wage, allowance or any other payment or such wage as may be provided by Presidential Decree shall be expected.
Article 30 (Liquidation)
(1)
In case the rightful person requests liquidation following the death or retirement of a worker, an employer shall deliver his wages, compensation or all other cash and goods due to the worker not later than fourteen days there after. However, the term of payment may be extended by an agreement of both parties when special circumstances warrant.
(2) Unpaid wages earned by employees before the declaration of bankruptcy or judicial liquidation of the employer's business shall be given first preference and shall be paid in full before other creditors may establish any claim to a share in the assets of the employer.

Section 19
Every employer shall pay to each of his employees not later than the seventh day after the last day of any wage period the wages, less lawful deductions, earned by such employee during such wage period:
Provided that if the Director-General is satisfied that payment within such time is not reasonably practicable, he may, on the application of the employer, extend the time of payment by such number of days as he thinks fit.
