Further to my minute of 13 March on the above subject, I now enclose a copy of a letter from Mr Handy in which he enclosed a cheque for £980. You will wish to consider what action to take in relation to the outstanding passage money. There is a very considerable discrepancy between Mr Handy's account of the action he took on cancellation and the account of the Director of the Agency. Mr Handy maintained at all stages that he has been awaiting the refund from them, while the Director insists that he told Handy at an early date that there would be no refund (I would suspect any Agency which would issue an invoice for a sum not actually charged!).

2. My own feeling is that, all in all, we have been very lucky to get a refund from Mr Handy. He could easily have counterclaimed that the last-minute cancellation of his assignment by Professor Turner caused him to lose the opportunity for other vacation work.

3. My suggestion would be that action to recoup should now be transferred from Mr Handy to the Travel Agency and that Northern Travel should be asked for an explanation as to why no refund accrued to Mr Handy. Perhaps, either at this stage or the next, they could be asked for copies of their correspondence with the companies concerned in which refunds were requested and refused. leave you to consider this in consultation with your Legal Advisers.
