SUBJECT MATTER

In December 1977 the Community agreed to the renewal of the Multifibre Arrangement (MFA) for a further four years. Pending formal adoption of the 25 bilateral agreements initialled under the renewed MFA and to give immediate effect to the quotas from 1 January 1978 the Commission adopted Regulation (EEC) 3019/77 of 30 December 1977, confirmed by Council Regulation 265/78 of 7 February 1978 (On the proposal for which, S/183/78, an explanatory memorandum was sub- mitted by the Department of Trade on 30 January 1978). A proposal for a Council Regulation (S/1387/78, the subject of an explanatory memorandum by the Department of Trade on 22 November 1978) will, if adopted, supersede that Regulation. It will provide for the implementation of the terms of the bilateral agreements up to 1982 by setting out internal Community procedures and the quantitative limits.
2 One of the bilateral agreements initialled at the end of last year was with Hong Kong. The purpose of the proposed regulation is to ratify this agreement which will last for five years until 31 December 1982. It is in a standard form common to all those made with low cost suppliers and sets out agreed quota coverage, quota levels and growth rates; licensing and control procedures; flexibility allowed in the operation of the quotas and consulta- tion provision. It also contains provision for the introduction of new quotas if imports of products not initially subject to restraint reach certain specified levels.
3 It has taken some time to bring the agreement forward for ratification since it was necessary for the Hong Kong authorities to give their final agreement to the contents of the Agreement.

Primary responsibility lies with the Secretary of State for Trade. The Secretary of State for Industry also has a policy interest.
IMPACT ON UK LAW
5 No UK legislation (subordinate or other) would be required to implement the proposed regulation. The quotas have already been implemented in the UK by an amendment of the current Open General Import License dated 13 June 1977 (as amended) made under the Import of Goods (Control) Order 1954. Any further quotas would be implemented in a similar fashion.
