Article 11 (1) (basket withdrawals)
Re paragraph 1
Most delegations were in favour of deleting the word "retrospective".
The Commission representative entered a general reservation on this deletion. Referring in this context to the compromise proposal made unofficially by the Belgian delegation as regards Article 1(3) of the proposal for a Regulation (2), the Commission representative pointed out that this solution might adversely affect the Community's credibility and jeopardize the security enjoyed by supplier third countries under the bilateral agreements.
Re paragraphs 5 to 8
(i) Role of the Member States in the basket withdrawal procedure
On a general level, the Belgian delegation referred to its concern about the imbalance in the proposal for a Regulation between the Commission's powers and those of the Member States compared with the provisions contained in Council Regulations Nos 109/70 and 1439/74. It noted in particular that the Commission proposal did not make provision for the triggering of safeguard measures at national level or recourse to emergency measures before consultations started.

are not included in this note. The Commission representative said that the paragraphs in question would be the subject either of bilateral talks between the Commission and the delegations concerned or of new drafting proposals.
