On the basis of this assurance, the Board agreed to the points recommended by the Chief Explosives Officer; namely, 19 points to Imperial Chemical Industries

and 30 points to. Du Pont (Hong Kong) Ltd.

As regards the aspects "Safety record of product" and "Safety record of manufacture", the Board agreed with the Chief Explosives Officer's recommendation that both tenderers should receive the maximum of 10 points.

As regards the aspect "Speed of bringing into operation", the Chairman questioned whether in fact Du Pont (Hong Kong) Ltd.'s offer to bring their plant into operation within 12 months was meaningful, having regard to the proviso stipulated by this firm that "all govern- mental grants, licences and permits do not unreasonably delay progress". It was noted that Imperial Chemical Industries Ltd. had specifically declined from offering a shorter period "having regard to the obligations to obtain various permissions from the Director of Public

Works etc.

After discussion it was agreed that as Du Pont (Hong Kong) Ltd. had confirmed its willing-

ness to enter into a contractual agreement to complete within a shorter period, the full 5 points should be awarded to this tender, with nil points to Imperial

Chemical Industries Ltd., as recommended by the Chief Explosives Officer.

As regards the aspect "Tendered premium", the Board agreed that the full 30 points should go to Imperial Chemical Industries Ltd. for offering the higher premium

of $20,025,000, while Du Pont (Hong Kong) Ltd. should receive 19.5 points calculated proportionately on its offer of $13,000,000.
